Service

1.1 — What you are purchasing

Purchasing a Suhween product gives you a license to use that product according to these terms. You are not purchasing ownership of the original intellectual property, mesh, textures, design, source files or other included work.

1.2 — Personal use

Purchased products may be used for your own personal projects, avatars, renders, videos, screenshots, streams and other personal creative work unless an individual listing states otherwise.

1.3 — Commercial use

Unless an individual listing specifically states otherwise, Suhween assets may be used as part of a completed commercial avatar or model that you sell.

Your customer may use the completed model they purchased from you, but they do not receive permission to extract, redistribute, resell or reuse my original asset separately.

1.4 — Commercial credit

When a Suhween asset is used on a commercial avatar or other commercial product, credit to Suhween should appear somewhere reasonably visible within the product listing or credits unless a specific listing states otherwise.

1.5 — Public VRChat avatars

Suhween assets may be used on public VRChat avatars unless the individual listing specifically prohibits public use.

Making an avatar public does not grant other users permission to extract, rip, reuse, resell or redistribute the original asset.

1.6 — Streaming + social media

You may display completed creations using Suhween products in streams, videos, social media posts, promotional renders and similar content.

This permission does not include distributing the original product files themselves.

2.1 — Editing products

You may recolor, retexture, rig, optimize, reshape, edit or otherwise modify a Suhween product to suit your project.

You may not claim that the original product or original design was created by you.

2.2 — Modified versions

Modifying a product does not create a new independent license and does not transfer ownership of the original work to you.

Modified versions of a Suhween product may not be redistributed or sold as standalone assets unless I have specifically given written permission.

2.3 — Frankenediting + combining assets

Suhween assets may be combined with your own work or properly licensed work from other creators when creating a completed project.

Combining several assets together does not give permission to redistribute their source files as a new asset pack or standalone product.

2.4 — Porting to other platforms

You may personally port an asset to another platform or software environment where technically possible.

The ported files remain subject to the same license and may not be uploaded to a public database, asset repository or file-sharing service.

3.1 — Ownership

Suhween retains ownership and copyright in the original work.

A purchase gives you permission to use the product under the applicable license. It does not transfer copyright or ownership of the original product to you.

3.2 — Redistribution

Redistribution of the original product files is prohibited.

Redistribution includes giving, sending, uploading, sharing, trading, leaking, reselling or otherwise making the product files available to another person without permission.

This applies whether the files are shared for money or for free.

3.3 — Sharing with friends

Purchases are licensed to the purchaser.

If a friend, collaborator or another creator needs the original product files for their own use, they must purchase their own copy unless I have specifically approved another arrangement.

3.4 — Renaming or converting files

Renaming, converting, recoloring, optimizing or otherwise modifying the product does not remove these restrictions.

3.5 — Asset dumps + repositories

Products may not be uploaded to asset dumps, leak servers, public drives, repositories, ripping communities, file-sharing websites or similar services.

4.1 — Permitted use

Suhween assets may be used on fictional models with youthful, child-like, chibi, doll-like, small or otherwise young-looking proportions.

4.2 — Prohibited sexualization

My assets may not be used for sexual, fetishistic, exploitative or predatory content involving minors or minor-coded characters.

5.1 — Prohibited uses

Suhween products may not be used for:

• Illegal activity
• Sexual or exploitative content involving minors or minor-coded characters
• Unauthorized redistribution or resale
• Asset dumps, ripping databases or leak repositories
• Fraudulent impersonation of Suhween
• Claiming authorship of my original work
• Uses specifically prohibited on the individual product listing

5.2 — NFTs + blockchain

Unless I have specifically provided written permission, Suhween products may not be minted, tokenized or sold as NFTs or used as part of blockchain-based collectible projects.

6.1 — Training datasets

Suhween models, meshes, textures, renders, product images, designs and other files may not be intentionally added to an AI or machine-learning training dataset without my written permission.

6.2 — Generative models

My work may not be intentionally used to train, fine-tune or create a competing generative model without written permission.

6.3 — AI-assisted creative software

Using normal creative software that happens to contain AI-assisted features does not automatically violate these terms.

The restriction specifically concerns intentionally using my work as training material or dataset content.

7.1 — Digital product policy

Because Suhween products are downloadable digital goods, sales are generally final and non-refundable once the product has been delivered or accessed, except where otherwise required by applicable law.

7.2 — Refund discretion

I may choose to approve a refund, replacement, exchange or store credit in an exceptional situation at my discretion.

Approving an exception once does not create a general right to refunds or guarantee that another request will be approved.

7.3 — Situations that may be considered

Examples I may consider include an accidental duplicate purchase or a confirmed issue with the supplied product that I am unable to reasonably resolve.

7.4 — Situations generally not refundable

Changing your mind, purchasing the wrong product, failing to read the product description or discovering after purchase that your personal setup does not meet clearly listed requirements generally does not qualify for a refund.

8.1 — Product issues

If you encounter a legitimate issue caused by the supplied product files, I will make a reasonable effort to troubleshoot the problem, provide corrected files or otherwise resolve it.

8.2 — Scope of support

Product support covers reasonable issues directly related to the purchased asset.

Support does not include teaching Blender, Unity, Substance Painter, VRChat development or other software from scratch, completing your project for you or troubleshooting unrelated third-party assets.

8.3 — Compatibility

Compatibility may vary depending on Unity versions, VRChat SDK versions, shaders, avatar bases, third-party software, file formats and platforms.

Always review the individual product listing before purchasing.

8.4 — Future updates

I cannot guarantee compatibility with every future software update, avatar base, shader, platform or third-party tool unless that compatibility is specifically advertised.

9.1 — Ripping

Ripping, extracting, decompiling or otherwise obtaining a Suhween product from another person's avatar, game build, uploaded model or compiled project without authorization is prohibited.

9.2 — Unauthorized redistribution

Unauthorized redistribution of Suhween products, including modified versions, may result in takedown requests, reports to the applicable platform or other appropriate action.

9.3 — Circumventing restrictions

Attempting to bypass these restrictions through loopholes, intentional misinterpretation, file conversion or minor edits does not make otherwise prohibited redistribution permitted.

10.1 — Future service

To the extent permitted by applicable law and the platforms or payment processors I use, I reserve the right to refuse future sales, support, collaborations, commissions, community access or other services.

10.2 — Serious community conduct

This may apply where I reasonably believe someone has engaged in serious harmful conduct, including:

• Predatory or sexually inappropriate conduct involving minors
• Sexual exploitation of minors or minor-coded characters
• Harassment, stalking, threats or doxxing
• Scams or fraud
• Knowingly false or malicious payment disputes
• Leaking or knowingly distributing ripped assets
• Theft or unauthorized redistribution of creators' work
• Impersonation
• Repeated or deliberate violations of creator licenses
• Other serious conduct that creates a reasonable safety, trust or community concern

10.3 — Community reputation

Personal disagreements or rumors alone are not automatically treated as proof of serious misconduct.

Decisions may be based on the circumstances available to me, including documented behavior, credible safety concerns, license violations or other information relevant to whether I am comfortable continuing a business or community relationship.

10.4 — Previous purchases

I am not required to continue doing business with someone solely because they have purchased from Suhween previously.

Refusing future service does not automatically revoke a valid license for a previous purchase and does not override rights provided by applicable law.

11.1 — Material violations

A license may be terminated where the purchaser materially violates its terms, including unauthorized redistribution, leaking, ripping, prohibited resale or other prohibited usage.

11.2 — Personal disagreements

Simply being disliked by me or another creator is not by itself a violation of a product license.

12.1 — Billing problems

If you believe there is a billing or purchase problem, please contact me when possible so I have an opportunity to review the issue.

12.2 — Fraudulent disputes

Knowingly false or fraudulent chargebacks may result in refusal of future purchases, support or services.

12.3 — Dispute evidence

When responding to a payment dispute, I may provide relevant purchase records, download information, communications and applicable license terms to the payment processor.

12.4 — Legitimate consumer rights

Nothing in these terms prevents a customer from exercising legitimate rights through their payment provider or applicable consumer law.

13.1 — Discontinued products

Suhween may update, replace, archive or stop selling a product at any time.

13.2 — Existing purchases

Removing a product from the storefront does not automatically cancel a license that was validly received with a previous purchase.

13.3 — Continued updates

Discontinued or older products are not guaranteed to receive unlimited future compatibility updates, revisions or support.

14.1 — Future revisions

These terms may be updated as Suhween's products, platforms, software, community or business practices change.

14.2 — Dated updates

Major policy revisions will be dated whenever practical.

14.3 — Product-specific terms

New purchases are subject to the terms provided with the product and storefront at the time of purchase, including any product-specific restrictions shown on that listing.

15.1 — Questions

If you are unsure whether a particular use is allowed, contact me before distributing or selling the project.

15.2 — Product support

The best way to reach me for product-related questions or support is through my official Discord server or whichever official support method is currently listed on the Suhween storefront.
